1 General introduction – definitions and provisions

1.1 Congobet is owned by a company legally registered under the laws of Congo, with registration no.

1.2 "Congobet Rules" means the terms and conditions which constitute the complete, final and exclusive agreement between the Account Holder and Congobet and which govern the contractual relationship between Congobet and the Account Holder. The Congobet Rules supersede and incorporate all prior agreements, representations and understandings between the Account Holder and Congobet. By opening a Congobet Account, as well as by registering, logging in, using the Services, participating in Games or accepting any Prize, a Visitor or Account Holder fully understands and agrees:

 

a. to become a party to the Congobet rules,

b. that he has read, understood and will comply with these terms and conditions and

c. that he will observe all their provisions.

 

Congobet may update, modify, edit and supplement the Congobet rules at any time. Any substantial change to the Congobet rules will be notified in advance by Congobet to the account holder before it comes into effect .

 

All references in the Congobet rules to the singular form include the plural form and vice versa. All references to the definite article form include the indefinite article form and vice versa.

 

1.3 "Account Holder" means a person who has entered into contractual relations with Congobet by creating a Congobet account on the website.

 

1.4 “Congobet Account” means an account held by an Account Holder, for bona fide transactions, with the strict objective of establishing normal commercial relations with Congobet and for the strict purpose of making bets and other gaming and gambling transactions.

 

1.5 “Contract” means the contractual relationship between Congobet and an account holder and is constituted in accordance with and governed by the Congobet rules, i.e. the Terms and Conditions.

 

1.6 “Competent Authorities” are the authorities of Romania .

 

1.7 “Applicable Law” is the law of the Democratic Republic of the Congo.

 

1.8 The “Place of Contract” is the Democratic Republic of the Congo.

 

1.9 “Regulatory Authority” means the national gambling institution of the Democratic Republic of the Congo, which is a regulatory authority established by law to regulate all forms of gambling in the Democratic Republic of the Congo.

 

1.10 “The Website” means the internet portal accessible via the internet address www.Congobet.ro, where all current and relevant information about Congobet operations is published and through which services are provided to account holders.

 

1.11 "Services" means the gaming and betting offers that Congobet makes available to the account holder through the website.

 

1.12 “Gambling and Betting Tax” refers to the special tax applicable to gambling and betting in the Democratic Republic of the Congo.

 

1.13 “Card” refers to all types of cards that have a “payment”, “charge”, “debit”, “credit”, “virtual” and/or similar function.

 

1.14 “Payment Solution Provider” is an intermediary that acts as a payment agent for several different payment methods.

 

1.15 “Financial Institution” means a bank and/or other institution regulated by national law applicable to financial services or by similar law.

 

1.16 “Force Majeure” means any event or situation beyond the reasonable control of a person, which causes the affected party to perform late or fail to perform its contractual obligations, and, for the purposes of the Congobet rules, includes acts of God, government restrictions (including the refusal or cancellation of any necessary license, if the refusal or cancellation occurs without any fault of the affected party), wars, outbreak of hostilities, riots, civil commotions, insurrections, acts of terrorism, fires, explosions, floods, theft, deliberate damage, strikes, lockouts and/or any other cause beyond the reasonable control of the party whose performance is affected.

 

1.17 “Client Application” means the internet browser application opened by the Account Holder to use the Services.

 

1.18 “Software ” means the software used by Congobet to provide and/or operate the Services and/or to run the Client Application.

 

1.19 “Prize” means an amount, bonus or reward that can be obtained by the account holder.

 

1.20 "Inactive Account" means a Congobet account that has not recorded any login and/or logout for a period of more than 12 consecutive months.

 

1.21 All trademarks, service marks and trade names, as well as images, graphic representations, texts, concepts or methodologies (collectively referred to as "intellectual property") found on the Site, the Client Application and the material contained therein constitute the exclusive property of Congobet and/or Congobet's suppliers and partners. The Account Holder is not entitled to exploit or otherwise use the intellectual property for any purpose, except as permitted by law.

 

 

 

2 Account rules

2.1 Creating a Congobet account

 

2.1.1 A person may not participate in a cash game unless that person is an account holder. To be registered as a player, a person must submit a registration request and provide at least the following information:

 

(a) are aged 18 years or above (it is an offence to gamble if not 18 years or older);

 

(b) are legally capable of entering into binding contracts;

 

(c) are located in a jurisdiction in which it is lawful to open an account with us and to use our Services;

 

(c) are the person you claim to be in your registration you are providing accurate, current and complete information and that you will promptly update the information you provide to us when it changes;

 

(d) are acting as principal and are not acting on behalf of someone else;

 

(e) have not previously held an account which was terminated either by us or by any other gambling/gaming operator by reason of breach or improper or unlawful behaviour;

 

(f) are not prohibited for any reason from betting with us or from using the Services; and

 

(g) have not excluded yourself, and nor have you been excluded by any third party, from gambling. When you open your Account you will be asked to provide us with personal information, including your name and date of birth and appropriate contact details and e-mail address.

 

2.1.2 An individual applying to become an account holder warrants and represents that they are not under the age of eighteen (18). Minors may not register as players and may not hold a Congobet account. Congobet reserves the right to request proof of the applicant’s age and to conduct checks to verify the information provided. A Congobet account may be suspended until satisfactory proof of the applicant’s age is provided.

 

2.1.3 A person applying to become an account holder also warrants and represents:

 

a. that he/she is a natural person (a legal person will not be accepted as an account holder);

b. that he is not a professional player in any sport, competition or league in which Congobet offers bets;

c. that it is not limited as a result of restricted legal capacity;

d. that he is not acting on behalf of another person;

e. that he/she is not classified as a compulsive problem gambler and that he/she is not included (voluntarily or forcibly) in any register or database of excluded gamblers;

f. that he does not deposit money that comes from criminal activities and/or other unauthorized activities;

g. that he does not deposit money through a card that the account holder is not authorized to use and that he does not use a card in a jurisdiction where betting and gambling are prohibited;

h. that it does not carry out criminal activities in which a Congobet account is directly or indirectly involved;

and that he does not hold an active account with another legal entity belonging to the same group as Congobet, or with other entities controlled directly or indirectly by Kindred Group Plc;

j. that he does not use the services if it is illegal in his country of residence or if he is otherwise prohibited from opening a gaming account, purchasing or using the services of Congobet and/or otherwise participating in the games offered. It is the responsibility of the Account Holder to ensure that his use of the Congobet website and services is legal;

k. that he does not consider the site or services to be offensive, objectionable, unfair or indecent; and

l. that he/she keeps his/her Congobet account details up to date with regard to the following: first and last name, country of residence, valid email address and telephone number;

m. that they do not engage in Bonus Abuse.

 

2.1.4 A person applying for a Congobet account acknowledges and accepts:

 

a. all definitions and provisions mentioned in the Congobet rules;

b. the Congobet rules, as currently published on the website, as well as any possible future changes to these rules;

c. that the place of the contract is Romania; and

d. that the contract is governed by: (i) the Congobet rules, as published in Romanian; (ii) any regulatory provisions or other decisions made from time to time by the competent authorities; (iii) the law applicable at the place of the contract.

 

2.1.5 A person applying for registration warrants and represents that any information provided in the application form is true and correct. Otherwise, Congobet will not register the person and, if the person has already been registered, Congobet will block the Congobet account upon becoming aware that the person provided false information when registering as a player.

 

2.2 Congobet account management

 

2.2.1 Congobet reserves, at its discretion and at any time, the right to:

 

a. refuse to open a Congobet account and/or close or suspend an existing Congobet account without any explanation;

b. refuse to accept deposits, without any explanation;

c. request documents to verify (i) the identity of the account holder, (ii) his/her authorization to use a particular card and/or (iii) other data and information provided by the account holder. This request may be made at any time and Congobet reserves the right to suspend an account while under investigation;

d. transfer and/or license , without prior notice, data relating to an account holder to any other legal entity, in any country, ultimately managed and controlled by Kindred Group Plc., subject to Congobet ensuring that said data is transferred and managed, at all times, in accordance with applicable legal provisions, data protection legislation and/or other applicable laws;

e. transfer and/or license , without notice, the rights and obligations relating to an account holder to any other legal entity, in any country, ultimately managed and controlled, subject to Congobet guaranteeing the fulfillment of the obligations;

f. to keep and manage funds belonging to account holders in accordance with generally accepted cash management rules with respect to such funds;

g. to withhold and/or confiscate funds available in a Congobet account and/or to refuse to honor a claim, in the event that, directly or indirectly: (i) Congobet rules have been violated and/or (ii) other unauthorized activities have been committed in connection with a betting event and/or in connection with the operation of a Congobet account (such as, but not limited to, violation of law or other regulations, violation of third party rights, fraud and cheating);

h. suspend and/or cancel an account holder's participation in games, promotional activities, competitions or other services if Congobet believes that there are legitimate concerns that a Congobet account is, has been or may be used for illegal, fraudulent or unfair practices;

i. suspend and/or terminate the account holder's participation in the services and/or withhold and/or confiscate the funds available in his/her Congobet account, if the account holder is found to be cheating or if it is determined by Congobet that the account holder has used or is using a system (including machines, robots, computers, software products or any other automated system) designed to disable or capable of disabling the client application and/or software.

j. close the game account if the player does not confirm the authenticity of the data provided at the time of registration, within 30 calendar days from the moment the account was credited, or if his/her name appears on the list of self-excluded and undesirable persons, and we will also retain and transfer to the state budget any amount of money that is in the account at the time of closure.

k. transfer players' money to the state budget if the game account was closed and the player did not provide Congobet with a valid bank account.

l. refuse and/or reverse the withdrawal of unspent or unused funds until verification of those funds is deemed satisfactory.

 

2.2.2 If the Congobet account has been suspended in accordance with the above clauses and has remained suspended for a period exceeding 12 months, Congobet will transfer the funds from the suspended gaming account to the player's bank account, and if the bank account is no longer valid, the gambling operator will transfer the money from the respective gaming account to the state budget of the Democratic Republic of the Congo. Congobet reserves the right to close the suspended account once the account balance reaches zero.

 

2.2.3 Congobet guarantees and declares, at all times, that:

 

a. manages funds belonging to account holders in a safe and proper manner; and/or

b. absorbs the cost of and pays the gambling and betting tax, as applicable, at the place of the contract;

c. manages data relating to an account holder in accordance with applicable legal provisions, data protection laws and/or other similar laws;

d. does not offer customers contingencies to proceed with transfers of funds between customer accounts.

 

2.2.4 Congobet keeps account holders' funds separate from Congobet's own funds in a client account held at a financial institution approved by the regulatory authority.

 

2.2.5 A Congobet account is not interest-bearing. The account holder does not equate Congobet with a financial institution.

 

2.2.6 An account holder may only hold one Congobet account at a time. In the event of a breach of this rule, Congobet reserves the right to block and/or cancel the additional Congobet account(s) held by the account holder in breach of this clause and to reallocate all funds to a single Congobet account. Bonuses awarded to the additional Congobet account(s) will not be reallocated.

 

2.2.7 A Congobet account is non-transferable. Players are prohibited from selling or transferring accounts to other players or acquiring accounts from other players. Funds cannot be transferred between Congobet accounts.

 

2.2.8 An account holder may not allow any other person, including a minor, to use or reuse their Congobet account, access and/or use materials or information on the site, accept prizes or access and/or participate in the services.

 

2.3 Responsible Gaming – Account Settings

 

2.3.1 In the Congobet account settings, an account holder can:

 

a. to set a limit on the amount that can be bet or deposited into his Congobet account in a given period of time; the player's request to impose a limit on the amounts that can be deposited will be implemented within a maximum of 24 hours;

b. to exclude themselves from the game for a determined period of time.

3.3.2 An account holder who has set a limit in accordance with letters (a) above may change or revoke the limit in the Congobet account settings. The increase or revocation of the limit shall take effect 7 days after the change is recorded by Congobet. The decrease of the limit shall take effect immediately after the change is recorded by Congobet. Congobet shall not accept bets from an account holder contrary to a limit or exclusion set, as above, by the account holder.

 

2.3.3 Congobet reserves the right to set additional limits for gaming accounts, restrict access to products or close the gaming account.

 

2.3.4 Please be aware that gambling can be addictive. If a player feels they need help to overcome such an addiction, they should follow this link to the "Responsible Gambling" page on the website.

 

2.4 Inactive accounts

 

2.4.1 "Inactive Account" means a Congobet account in which no transaction has been recorded for a period of one year.

 

2.4.2 In the event that an Inactive Account has a zero balance, Congobet will close the Congobet Account and inform the Account Holder of such closure via email, using an email address registered with the Congobet Account.

 

2.4.3 In the event that an Inactive Account contains a balance, Congobet will inform the Account Holder that it has a balance remaining in an Inactive Account and that it has a period of one year from the date on which the Congobet Account became an Inactive Account to withdraw such balance or, alternatively, to reactivate the Congobet Account and use any balance for the Services. Congobet will also inform the Account Holder in the same communication that, if the Account Holder fails to take action within the said one-year period, Congobet will be obliged to remit the balance remaining in the inactive account to the Romanian state budget.

 

2.4.4 If the balance of an Inactive Account has not been withdrawn by the Account Holder or if the Inactive Account has not been reactivated, Congobet will remit the balance of such Inactive Account to the Romanian state budget, in accordance with the regulations on remote gambling. Once the balance has been remitted to the Romanian state budget, the money will be retained and the inactive account will be closed.

 

2.5 Payment refund

 

2.5.1 Subject to the sub-clauses below and without prejudice to Congobet's right to seek compensation under applicable law, regulations, normative instruments or policies or under any other provision of the Congobet rules, Congobet has the right to block a Congobet account in the event that a refund of a payment has been requested in relation to that Congobet account.

 

2.5.2 In the event that a refund has been requested, Congobet will send the account holder a “refund notification”, to the email address mentioned in the account holder’s identification data, in order to confirm the identity of the account holder and the payment method used to credit the account holder’s Congobet account with any funds that are completely unrelated to a refund (“untainted funds”).

 

In the absence of confirmation by the Account Holder of their identity and the payment method used to credit the untainted funds to the Account Holder's Congobet Account, following a chargeback notification, Congobet will send the Account Holder two written reminders to the email address provided to it, each of which will be subject to a processing fee of fifty (50) GBP, deducted from the untainted funds.

 

2.5.3 If a Congobet account has been blocked as a result of a chargeback and the account holder:

 

a. has not logged into his Congobet account for a period of thirty (30) consecutive months; or

b. failed to confirm to Congobet his/her identity and the details of the payment method used to credit the untainted funds to the account holder's Congobet account and then requested a withdrawal;

Unspent funds in the Congobet account will be treated as if they were funds from an inactive account and Congobet will remit the account holder's Congobet account balance to ONJN.

 

2.6 Closing a Congobet account

 

2.6.1 An Account Holder may close their Congobet Account by contacting Congobet Customer Support, by telephone or email, using the contact details provided in the “Get Help” section of the Website (www.Congobet.com/help). The funds in the Congobet Account will be released to the Account Holder.

 

2.6.2 In the event that an existing Congobet account is closed, any obligations already assumed will be honored.

 

2.6.3 Account holders who wish to recover funds held in a closed, blocked or excluded account are advised to contact customer support.

 

2.6.4 If a person's Congobet account has been closed due to gambling addiction or fraud, the person concerned must not open a new Congobet account. Congobet will not be liable if the account holder manages to open a new account nor for any direct or indirect damage caused. Congobet reserves the right to close an account opened in breach of this rule at any time.
